
The Federal Constitutional Court has provided major relief to builders in Karachi by lifting the ban on converting residential plots into commercial categories. However, the court made it clear that public spaces such as parks, hospitals, and playgrounds cannot have their categories changed.
The court also disposed of the case related to illegal constructions in Karachi.
During the hearing, Justice Aamir Farooq stated that the court would not interfere in the functioning of institutions like the Sindh Building Control Authority. He said that if any institution violates the law, the matter should be taken to the relevant forum or the High Court, and appeals can be filed if needed.
Justice Aamir Farooq further remarked that the court no longer holds suo motu powers and emphasized that laws already exist to deal with violations of building regulations. He expressed hope that town planning authorities would perform their duties in good faith.
Justice Arshad Hussain added that any official found violating the law would face action. The court also noted that the Supreme Court’s decision on changing plot categories should not obstruct institutions from carrying out their responsibilities, reiterating that courts enforce laws rather than create them.
